Cruise lines may change compensation laws

Costa Concordia tragedy could prompt rethink of Athens Convention

Travel industry lawyers believe that the Costa Concordia tragedy could prompt a rethink of the terms and conditions by which claims are brought against cruise lines. It could even lead to a new convention on the transportation of passengers by sea, adapting the Athens Convention drawn up in 1974.
Just as the 1999 Montreal Convention regulating the international carriage of aircraft passengers is an update from the 1929 Warsaw Convention taking into account compensation for air disasters, the Athens Convention may now also need updating.
Costa Cruises has offered passengers around €11,000 compensation for lost baggage and psychological trauma, but under the Athens Convention passengers can be awarded up to €45,000. In the UK, it can be as high as the equivalent of €290,000.
